🧾 How to Submit a FOIA Request
All FOIA requests for public records should be made in writing so we can accurately understand and process your request. A written request may be submitted online, by email, mail, or in person.
Please include:
- Your full name
- Your Arkansas mailing address or other contact information
- A clear description of the records you are requesting Include dates, departments, and subjects if possible
- Your preferred delivery method (email, pickup, or mail)
- Whether you prefer digital copies (PDF/email) or paper copies
⏳ Response Time & Processing
Under the Arkansas Freedom of Information Act, most non-exempt public records must be made available for inspection and copying within a reasonable time. Records that are not immediately available are generally provided within three (3) business days, unless they are in active use, storage, or otherwise exempt.
- Simple requests for readily available records may be fulfilled sooner than three business days.
- Large, complex, or multi-department requests may require additional time. If so, the district will notify you within the three-business-day window and explain next steps.
- If any part of your request cannot be fulfilled because it is exempt by law, we will provide the non-exempt portions when possible and explain any redactions or denials.
💲 Fees
Fountain Lake School District may charge only the actual costs of reproducing records and any applicable mailing or media costs, as allowed by Arkansas law.
- Per-page copying costs
- Actual cost of media (e.g., USB drive, CD) if requested
- Postage or shipping for mailed records
- In limited cases, additional costs for unusually large or burdensome requests as permitted by law
When possible, we will provide an estimate of fees before completing your request. Digital delivery (email/PDF) is encouraged to help minimize costs.
📂 What Records Are Subject to FOIA?
In general, “public records” include writings, recordings, electronic data, emails, and other materials that document the performance of official functions by the district, its employees, or its boards.
Examples may include:
- School board agendas, minutes, and supporting documents
- Approved district policies and procedures
- Certain financial and budget documents
- Contracts and many purchasing or procurement records
- Some personnel information (such as name, job title, and salary), subject to legal limits
🚫 Records That May Be Exempt
Some records cannot be released, or can only be released in part, due to state or federal law. Common examples include:
- Student educational records (protected by FERPA)
- Medical, counseling, or other confidential records
- Certain personnel or evaluation records, especially when release would be a clearly unwarranted invasion of personal privacy or additional FOIA conditions are not met
- Security-sensitive information, including emergency response plans, vulnerabilities, and some security camera footage
- Records related to ongoing or undisclosed criminal investigations
- Certain personal contact information of non-elected employees
When records contain both releasable and exempt information, the district may provide a redacted version showing only the releasable portions.
